申不害 (Shēn Bùhài, c. 400–337 BCE) was a political philosopher and statesman of the Warring States period, best known as chief minister (相) of the state of Hán 韓 under Marquis Zhāo (韓昭侯, r. 358–333 BCE). His tenure, conventionally dated to c. 351–337 BCE, lasted approximately fourteen years, during which he is credited in the Shǐjì and Hánfēizǐ with strengthening Hán through administrative consolidation. He died in office around 337 BCE.
Within the classical taxonomy of Legalism (法家 fǎjiā) 申不害 is identified as the primary theorist of shù 術 — the ruler’s covert “techniques” for appointing ministers by objectively assessed merit, holding them accountable to their stated duties, and preventing any single minister from accruing sufficient influence to overshadow the throne. This emphasis on personnel management distinguishes his approach from the emphasis on codified law (fǎ 法) associated with 商鞅 and the emphasis on strategic positional power (shì 勢) associated with 慎到 and, later, 韓非. The Hánfēizǐ contains several passages directly critiquing 申不害’s reliance on shù without consistent fǎ.
His birthdate is not recorded; the estimate of c. 400 BCE is a scholarly inference consistent with his documented career. CBDB contains no entry for 申不害. His native place is traditionally given as Jīngguo 京國 (modern Xíngyang 滎陽, Henan).
